TERMS & CONDITIONS

These Terms & Conditions apply to plumbing, construction, remodeling, repair, service, installation, and related work performed by Viking Elite LLC ("Viking Elite") and supplement the applicable signed contract, proposal, estimate, work order, service authorization, or Change Order. If a signed agreement contains a term that directly conflicts with these Terms & Conditions, the signed agreement controls.
1. PAYMENT TERMS
Payment is due according to the payment terms stated on the invoice, contract, estimate, or other written agreement. Unless otherwise stated in writing, payment is due upon completion of the invoiced work.
Customer shall promptly notify Viking Elite in writing of any good-faith dispute concerning an invoice. The existence of a disputed item does not relieve Customer from timely payment of all undisputed amounts.
2. LATE PAYMENT & INTEREST
Any unpaid balance not paid when due may accrue interest at the contractual rate of two percent (2%) per month (24% APR) from the applicable due date until paid, subject to applicable law.

3. COLLECTION COSTS
If an amount remains unpaid when due and is referred to a collection agency or other third-party collector, Customer agrees to pay an additional collection surcharge equal to thirty percent (30%) of the amount referred for collection, together with reasonable attorney fees, court costs, and other recoverable enforcement expenses, to the extent permitted and enforceable under applicable law.

4. ADDITIONAL & UNFORESEEN WORK
Unless expressly included in the written scope of work, Viking Elite is not responsible for concealed, pre-existing, or unforeseen conditions discovered during service, demolition, repair, or construction.
Such conditions may include, without limitation, deteriorated piping, improper previous installations, concealed plumbing or electrical lines, structural deficiencies, inaccessible piping, damaged drains, hazardous materials, mold, code deficiencies, or conditions that prevent the originally anticipated connection or installation.
Additional labor, materials, equipment, permits, testing, or repairs required because of such conditions may result in additional charges when authorized by the Customer or otherwise permitted under the parties' agreement.
5. EXISTING & CUSTOMER-PROVIDED MATERIALS
Viking Elite does not warrant fixtures, equipment, hardware, materials, or components supplied by the Customer or reused from an existing installation.
Customer acknowledges that existing components may fail, leak, break, or become unusable because of age, corrosion, deterioration, concealed defects, previous installation methods, or normal removal, testing, and reconnection.
Viking Elite is not responsible for failure or damage caused solely by a pre-existing defect or the inherent condition of an existing or Customer-provided component, except to the extent caused by Viking Elite's negligent or wrongful acts or omissions.
6. TESTING & ACCESS
Customer authorizes Viking Elite to reasonably operate, isolate, disconnect, reconnect, and test plumbing fixtures, valves, drains, piping, water heaters, boilers, pumps, faucets, toilets, tubs, showers, shutoff valves, and other systems as reasonably necessary to perform or verify the work.
Customer shall provide reasonable access to the property and affected systems.
7. WORKMANSHIP WARRANTY
Viking Elite warrants that its labor will be performed in a workmanlike manner and in accordance with applicable codes and the written agreement.
Unless a different written warranty applies, Viking Elite will correct covered workmanship defects reported within one (1) year after substantial completion.
The workmanship warranty does not cover normal wear, abuse, improper maintenance, freezing, movement or failure of the existing structure, pre-existing conditions, Customer-provided or reused products, alterations by others, or manufacturer defects.
Manufacturer warranties remain subject to the applicable manufacturer's terms.
8. DAMAGE & PRE-EXISTING CONDITIONS
Construction, plumbing repair, demolition, and remodeling may require disturbance of existing finishes and may expose previously concealed conditions.
Viking Elite will exercise reasonable care while performing the work but is not responsible for damage attributable solely to pre-existing defects, concealed conditions, deterioration, or work performed by others.
Nothing in these Terms releases Viking Elite from responsibility for damage caused by its own negligent or wrongful acts or omissions to the extent such responsibility cannot lawfully be waived.
9. HAZARDOUS MATERIALS & MOLD
Viking Elite is not a mold, asbestos, or hazardous-material remediation contractor unless separately licensed and expressly contracted to perform such work.
If suspected mold, asbestos, hazardous substances, gas, chemicals, or unsafe conditions are discovered, Viking Elite may stop the affected work until the condition has been properly evaluated and made safe.
Testing, remediation, delays, and additional work resulting from such conditions are outside Viking Elite's scope unless otherwise agreed in writing.
10. MECHANIC'S LIEN RIGHTS
Viking Elite reserves all mechanic's lien, payment, collection, and other remedies available under applicable Idaho law.
Nothing contained in these Terms & Conditions is intended to waive any notice, disclosure, lien, payment, or consumer requirement that cannot legally be waived.
11. ATTORNEY FEES & ENFORCEMENT
In any action or proceeding arising from an unpaid invoice, breach of the parties' agreement, or enforcement of payment obligations, Viking Elite may seek reasonable attorney fees, court costs, collection costs, interest, and other remedies to the extent permitted by the agreement and applicable Idaho law.
All available remedies are cumulative unless otherwise required by law.
12. GOVERNING LAW
These Terms & Conditions and the underlying transaction shall be governed by the laws of the State of Idaho.
Any legal proceeding concerning the work or amounts owed shall be brought in a court of competent jurisdiction as provided by applicable Idaho law and the parties' underlying written agreement.
13. ENTIRE AGREEMENT
These Invoice Terms & Conditions supplement Viking Elite's applicable contract, estimate, proposal, work order, service authorization, Change Order, and other signed project documents.
Nothing printed on an invoice is intended to eliminate or reduce rights or obligations established by a previously executed written agreement. If there is a direct conflict, the applicable signed agreement controls.
